Brief Background

The petitioners, who had worked as Caretakers, Caretaker Relievers, and Sweepers at COVID isolation centres operated under DUSIB during the COVID-19 period, approached the Delhi High Court alleging non-payment of their earned wages despite repeated representations. The dispute arose from directions previously issued to the labour authorities to decide the workers’ claims through a reasoned order.

Pursuant to those directions, the Labour Commissioner examined the records and concluded that the workers had performed duties between July 2021 and March 2022 and that their earned wages remained unpaid. The workers thereafter initiated contempt proceedings alleging non-compliance with the Labour Commissioner’s findings.


Order Passed by the Court

The Delhi High Court took serious note of the fact that despite categorical findings of the Labour Commissioner, the workers had still not received their pending wages. The Court expressed strong disapproval of the stand taken by DUSIB and observed that the submissions made on behalf of DUSIB reflected insensitivity towards workers who had served during the COVID-19 period.

The Court directed complete compliance of the payment obligations within two weeks. It further warned that if even one worker remained unpaid, the Chief Executive Officer of DUSIB would be required to personally appear before the Court and explain the non-compliance, failing which contempt consequences could follow.


Significance of the Order

This order reinforces the principle that government agencies and public authorities must comply with labour welfare obligations and cannot evade responsibility by shifting liability to contractors. The Court emphasized the importance of protecting workers who rendered essential services during the COVID-19 pandemic.

The decision also highlights the Court’s willingness to invoke contempt jurisdiction where administrative authorities fail to implement lawful directions concerning payment of workers’ wages.
